1. Acceptance of these Terms
These Terms of Service ("Terms") form a legally binding agreement between you and Hempstead Plumber ("Hempstead Plumber," "we," "us," or "our"), located at 415 Clinton St, Hempstead, NY 11550. By accessing this website, calling us, or hiring us to perform plumbing work, you agree to be bound by these Terms. If you do not agree, please do not use this site or our services.
2. Who We Are
Hempstead Plumber is a New York State licensed plumbing contractor, founded in 1981 and serving Hempstead and Nassau County. All work is performed under the supervision of a NYS licensed master plumber and we carry general liability and workers' compensation insurance. License and insurance information is available on request.
3. The Services We Provide
We offer residential and commercial plumbing services, including emergency plumbing, drain cleaning, water heater repair and replacement, leak detection, sewer line repair, bathroom and kitchen plumbing, pipe repair, frozen pipe repair, sump pumps, and gas boiler repair and installation. Specific scope, materials, and timelines for any given job are documented in the written estimate or work order signed by you and Hempstead Plumber.
4. Estimates and Pricing
We provide free phone consultations and free written estimates for most plumbing work. Estimates are valid for thirty (30) days from issue unless otherwise stated. Estimates are based on the visible conditions and information provided at the time of inspection. If hidden damage, code violations, or unforeseen conditions are discovered during the work, additional charges may apply and will be discussed with you and approved before any extra work is performed.
5. Scheduling and Service Calls
We make every effort to arrive within the scheduled window. Emergency response times depend on call volume, traffic, and weather, but we typically arrive within 2 to 4 hours for true emergencies in Hempstead. If we are unable to make a scheduled appointment, we will contact you to reschedule at the earliest available time.
6. Payment Terms
Unless otherwise agreed in writing, payment is due in full upon completion of the work. We accept cash, check, and major credit cards. Larger projects may require a deposit prior to scheduling, with the balance due on completion. Returned checks are subject to a fee of $35 plus any bank charges. Past-due balances may accrue interest at the maximum rate permitted by New York law.
7. Cancellations and Rescheduling
You may cancel or reschedule a non-emergency appointment at no charge by calling us at least four (4) hours before the scheduled arrival window. Same-day cancellations after a technician has been dispatched may be subject to a trip charge equal to our standard service-call fee.
8. Workmanship Warranty
We stand behind our work. Hempstead Plumber warrants the labor on most repairs and installations for a period of one (1) year from the date the work is completed, except where a longer warranty is specifically stated in the written estimate or work order. Manufacturer warranties on parts and equipment are passed through to you, the customer; we will help you with warranty claims at no additional charge for the same one-year period.
This warranty does not cover damage caused by abuse, accident, freezing, lack of maintenance, modifications by others, acts of God, or pre-existing conditions disclosed in the work order. The warranty is limited to the original customer at the original service address.
9. Customer Responsibilities
You agree to provide safe, reasonable access to the work area; to disclose any known plumbing or structural issues that may affect the work; to keep pets and minors away from the work area while we are present; and to obtain any approvals required by your landlord, HOA, or co-op board before we begin work. If permits are required, we will pull them on your behalf and the cost is included in the written estimate unless otherwise stated.
10. Limitation of Liability
To the fullest extent permitted by New York law, Hempstead Plumber's total liability for any claim arising out of or related to our services or this website is limited to the amount you paid us for the specific service that gave rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or property damage that was not directly caused by our negligence. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold Hempstead Plumber, its owners, employees, and subcontractors harmless from any claim, damage, or expense (including reasonable attorney's fees) that arises out of your breach of these Terms, your misuse of our services or this website, or any condition of the property that you failed to disclose.
